The NYCHRL requires employers and covered entities to use an individual’s preferred name, pronoun and title (e.g., Ms./Mrs.) regardless of the individual’s sex assigned at birth, anatomy, gender, medical history, appearance, or the sex indicated on the individual’s identification. Some pronouns included in the list are “zhim,” “sheer,” and “xem.” According to the law, the accompanying preferred gender pronouns do not have to reflect legal documentation, but “failure to use an individual’s preferred name or pronoun” is considered a violation and is subject to a minimum $125,000 fine.The policy states: The list of 31 genders results in a list of 56 sets of pronouns to accompany the genders. “Gender fluid” refers to a person whose gender can fluctuate between any of the other genders at any given time with or without control, while “gender gifted” refers to a person who has the mental and physical capacity to voluntarily fluctuate between or outside the “binaries,” whether in emotional state of mind, appearance, or mentality. “Hijra” refers to a South Asian biological transsexual male who becomes female.

Conversely, not all transgender people are gender non-conforming.” “Intersex” refers to “a person whose reproductive or sexual anatomy and/or chromosomal pattern does not fit typical definitions of male or female.” Not all gender non-conforming people are transgender. For example, “cisgender” refers to “a person whose self-identity conforms with the gender that corresponds to their biological sex.” “Gender non-conforming” refers to a person “whose gender expression differs from traditional gender-based stereotypes. The city website provides a comprehensive list of definitions for the non-binary gender terms. The City provided a list of non-binary genders protected under the law: Individuals can choose from a list of 31 different gender identities, only two of which (fe/male) are assigned at birth. In New York City (NYC), businesses that fail to accommodate a person’s chosen gender identity can incur a $250,000 fine, according to a non-discrimination policy implemented by NYC’s Commission on Human Rights.
